1) Acceptance of Terms

Welcome to Collaborative Psychiatry (the “Site”), operated by COLLABORATIVE PSYCHIATRY PLLC (“we,” “us,” or “our”). By accessing or using the Site, courses, private podcast feeds, downloads, and related services (collectively, the “Services”), you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Services. We may update these Terms from time to time; the date above shows the effective date of the most recent changes.

2) Who We Are / What We Do

We provide educational content for clinicians, including QuickTake podcasts, audio courses (some with CME credit via accredited partners), and downloadable resources. The Services are for educational purposes only and do not create a doctor–patient relationship.

3) Eligibility; Accounts

You must be at least 18 years old to use the Services. Some features require creating an account and maintaining accurate, current information. You are responsible for safeguarding your login credentials and for all activity under your account.

4) License to Use; Intellectual Property

All content—including audio, text, graphics, and PDFs—is owned by us or our licensors and protected by intellectual‑property laws. We grant you a personal, limited, non‑exclusive, non‑transferable license to access and use the Services for your own professional development. You may not reproduce, distribute, share, resell, or publish any content except as explicitly permitted in writing.

  • Private podcast feeds (if provided) are for one subscriber and must not be shared. We may revoke access if sharing, scraping, or bulk downloading is detected.

5) Prohibited Uses

You agree not to: (a) copy, record, or scrape the content; (b) circumvent access controls; (c) share credentials; (d) upload malware; (e) use the Services for unlawful purposes or to provide emergency/clinical advice; (f) reverse engineer any part of the Services; or (g) infringe intellectual‑property or privacy rights.

6) Subscriptions, Courses, Billing & Renewals

We offer paid memberships and one‑time course purchases through third‑party payment processors (e.g., Stripe). Prices and features are described on our Site and may change.

  • Auto‑renewal: Subscriptions renew automatically at the then‑current price unless canceled before renewal. You can cancel in your account settings.
  • Trials/Promotions: If offered, trials convert to paid subscriptions unless canceled before the trial ends.
  • Taxes: Prices may exclude taxes; applicable taxes are added at checkout.

7) Refunds & Cancellations

For full details, see our Refunds & Cancellations Policy. In summary: (a) renewals are generally non‑refundable; (b) refunds may be limited where there has been material consumption of gated content; (c) refunds are not available after CME credit is claimed. Approved refunds revoke access and disable private podcast feeds tied to the refunded item.

8) CME Terms

Some activities are offered via joint providership with accredited partners (e.g., PeerPoint Medical Education Institute). Earning CME credit may require completion of specific criteria (e.g., full activity, post‑test, evaluation). Certificates are issued by the accredited provider; timelines may vary. 9) Third‑Party Services

We may link to or integrate with third‑party services (e.g., payment processors, analytics, CME platforms, podcast hosting). We are not responsible for their content, policies, or practices.

10) No Medical Advice; Not for Emergencies

The Services provide educational information for clinicians and are not medical advice for any person or patient. In an emergency, call 911 (U.S.) or local emergency services. For mental‑health crises in the U.S., call or text 988.

11) Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

12) Limitation of Liability

To the maximum extent permitted by law, we (and our officers, directors, employees, contractors, and partners) are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, revenues, or data arising from your use of the Services.

13) Indemnification

You agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.

14) Governing Law; Venue; Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict‑of‑laws rules. You agree to exclusive jurisdiction and venue in the state and federal courts located in Westchester County, New York.

15) Changes; Termination

We may modify, suspend, or discontinue any part of the Services at any time. We may suspend or terminate accounts that violate these Terms or applicable laws.
